Terms of Service

By using SmartShelf ("the App," "we," "us," or "our"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. The App is operated by Johannes Forseth as an individual developer.

1. Use of the App

  • The App provides features to track food expiration dates and offer related functionalities (e.g., AI-assisted suggestions via OpenAI).
  • You must be at least 13 years old to use the App.
  • You agree to use the App in compliance with all applicable laws and not to misuse the App.

2. Subscription and Payment

  • The App may offer recurring monthly or yearly subscriptions for premium features or unlimited usage.
  • Payment is processed through Apple's in-app purchase system. Apple's payment terms apply.
  • Cancellation: You may manage or cancel your subscription at any time through your Apple ID account settings. We do not handle cancellations directly. Upon cancellation, you retain premium access until the current billing cycle ends. No partial refunds are provided unless required by law.

3. Intellectual Property

  • We own all rights, title, and interest in the App and its content, excluding user-generated input (e.g., text you type into the App).
  • You may not copy, modify, distribute, or sell any part of the App without prior written permission.

4. Third-Party Services

  • The App uses the OpenAI API for AI-related features. By using these features, you agree that your input text may be processed by OpenAI under their own Terms of Use and Privacy Policy.
  • We are not responsible for third-party services, their performance, or their policies.

5. Disclaimer of Warranties

  • The App is provided "as is" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose.
  • We do not guarantee the accuracy of expiration date predictions or AI responses. Users should always verify expiration dates on packaging.

6. Limitation of Liability

  • To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use the App.
  • Our total liability shall not exceed the amount you paid (if any) for the premium subscription during the twelve (12) months preceding the claim.

7. Indemnification

You agree to indemnify and hold harmless us and our affiliates from any claims arising out of your use of the App, your violation of the Terms, or your infringement of any third-party rights.

8. Changes to Terms

We may update these Terms from time to time. We will notify you by updating the "Last Updated" date. Your continued use of the App after changes means you accept the updated Terms.

9. Governing Law and Disputes

  • These Terms are governed by the laws of Norway, without regard to conflicts of law principles.
  • Any dispute arising from these Terms will be resolved in the courts located in Norway, unless required otherwise by applicable law.
